FERPA Statement:

It is violation of our policy for any user of this site to link any educational records, including any and all records defined by the Family Educational Rights and Privacy Act (FERPA), with any data derived from this site. You may not upload any existing student information to our site if that information was protected by the FERPA at anytime. You may not link any data derived from our site with any record that will later be covered by the FERPA. Review the FERPA here and seek legal advice if there are any questions regarding your intended use.
Except for a school or district that has signed our School Data Privacy Addendum (see below), Student Wellness Solutions operates independently of any public or private school system, school district, or institutional educational agency. We do not purposely collect or share any data that originated as a Student Record as defined by the FERPA, and we do not permit any data derived from our site to be used as a Student Record within any public or private school institution covered by the Family Educational Rights and Privacy Act or FERPA (20 U.S.C. §1232g; 34 CFR Part 99).
Our services are offered, and intended to be accessed only as a voluntary, non-academic, extra-curricular enrichment opportunity. To the extent that a parent or Group Client may use data from our site to administer an incentive for course enrollment or completion, we require that such incentives be administered without creating any link between FERPA protected educational records and our services.
Two kinds of group license. Student Wellness Solutions offers group licenses to organizations that choose to provide our voluntary programs to their members. If a license is paid for with public education funds, or is used at the direction of a public school or district, it must have School Privacy Settings turned on. With School Privacy Settings, group leaders see classroom totals only, never an individual student’s results, and never see a student’s name or email address; students self-register with a classroom code. Roster uploads and email invitations are switched off. This is built into the system. The license holder can turn School Privacy Settings on, but only Student Wellness Solutions can turn them off. A Private Organization license is for organizations paying with their own funds. It also shows Student IDs only. Email addresses are never shown to group leaders.
Student Wellness Solutions acts on its own behalf and not on behalf of any school, except for a school or district that has signed our School Data Privacy Addendum: for that school’s license only, Student Wellness Solutions acts as a school official under the school’s direct control, as the Addendum describes. Schools and districts can request the Addendum from our sales team.
If there is a question whether or not your existing records, or your use of records from our site, could be covered by the FERPA, you are advised to seek professional guidance. If we become aware of any violation of this requirement, we will take action immediately.
